22 Year Old Dating a 17 Year Old

My question involves criminal law for the state of: Illinois

Okay. I've seen other similar posts that got stickied with links to unhelpful websites.

I have read that there is a 5 year difference rule. But i'm not sure if this 5 year difference refers to the AGE of the persons, or their BIRTHDAYS

For instance. If this rule applies to the AGE, then a 17 year old and a 22 year old would not be legal sexually because they are 5 years apart.

But if in regards to the actual birthdays, in my case my birthday being january 16, 1989, and her birthday is october 17th, 1993, our age difference with regards to our birthdays would be in the legal limit by a margin of 2 months. We are 4 years and 10 months apart.

Which way of thinking is correct?

I have not been able to answer this question through reading statutes online.

I'm not sure why you're confused.

It would be based upon the date of birth. Which coincidentally would be the exact same thing as the actual difference in age....

Our ages 17 and 22 are 5 years apart. Illegal = 5 years difference

does the law consider as much detail as the months and days between our birthdays, or only just the solid years of our ages?

It's about the EXACT age difference.
