My question involves criminal law for the state of: Illinois
Okay. I've seen other similar posts that got stickied with links to unhelpful websites.
I have read that there is a 5 year difference rule. But i'm not sure if this 5 year difference refers to the AGE of the persons, or their BIRTHDAYS
For instance. If this rule applies to the AGE, then a 17 year old and a 22 year old would not be legal sexually because they are 5 years apart.
But if in regards to the actual birthdays, in my case my birthday being january 16, 1989, and her birthday is october 17th, 1993, our age difference with regards to our birthdays would be in the legal limit by a margin of 2 months. We are 4 years and 10 months apart.
Which way of thinking is correct?
I have not been able to answer this question through reading statutes online.
