    Can I do this if I file for separation too? Because of my religious beliefs, I do not want to file for divorce.
    California does allow you to request spousal support in a separation - however, as noted above, if hubby is only making $2000 a month, you're not likely to see much. Not only because of his income level, but also because one of the things the court looks at is the debts of each party, and if you've declared bankruptcy, and he hasn't, then the court may credit you with being effectively debt free - so in theory, if you have earning potential, he could come after YOU for support.

    Jimben gave you the best advice: you really need to be speaking with an attorney with knowledge on BOTH separation and bankruptcy - as I have a suspicion that the way your bankruptcy was structured may come back to haunt you by leaving your husband saddled with debt, while you enjoy relief.
