    Default Repairs for tenant who is being evicted

    In Illinois, do I legally have to make maintenance repairs for a tenant who is being evicted?

    We have been trying to get her out for a month and a half-- complete nightmare tenant. She currently owes $2100 in past rent. She refuses to abide by the house rules, throws her table scraps and trash in the common areas, and is so loud that we are losing other tenants. After being served with her eviction notice, she has let 5 or 6 more people move in with her. Almost every night they are in the parking lot yelling and cursing, and have had the police called on them numerous times by myself and several other tenants. Her eviction is tied up in the court system, and she should be out in about two weeks.

    Today, she had her 7 year old daughter leave a message that her toilet is clogged and her garbage disposal is not working. Do I legally have to fix this for her, or can I just leave it be and wait until she moves out?

    Please help!

    A Complaint for Unlawful Detainer (eviction), is just that. You have to prove up your case. Until then, she is a lawful tenant and you are required to maintain each unit in "habitable" condition; and that includes toilets. It does not include garbage disposals.

    So, until she's tossed out, you must maintain the unit in habitable condition.

    If I were you, while understanding your reluctance to repair, I would be concerned about what these people might do if their sink and toilet remain plugged for the next two weeks....
