    Default Bar Negligent for a Fight on Property

    My question involves injury or loss that occurred in the state of: New Jersey

    An event occurred on a bar's enclosed patio. One would have to go through the bar to get to it. My friend was sucker punched by a guy who sprinted off. The establishment's security nor the police caught him.

    The guy broke my friends cheekbone and had to have surgery to fix it.

    Is the bar at all liable for the incident?

    Was the guy who did the punching an employee of the bar? Is there any reason to believe that the bar had prior warning that the guy was going to punch your friend?

    If the answer to these questions is no, then the answer to your question is also no.

    In fact, unless the bar owner specifically assumes the liability of protecting any and all patrons, they are not responsible.

    So, as the previous poster stated, if the aggressor was not the owner of the bar, in that bar's employ or working on the directions of the bar's owners, they are not responsible.

    It is always someone's "friend". You have no standing. Is this person too dumb to speak with an attorney?

    In a nutshell, he would have to PROVE in a court of law that the bar had a duty to protect him from the assault.

    He would then have to prove that the bar i.e. its owners, failed in that duty.

    Then he would have to prove damages, and I doubt there are enough in damages for an attorney to bother trying to prove the above which is almost always next to impossible.
