    Default Harassment from Collectors

    I currently have an MBNA account in collections ($1700 total). I am now paying month to month as much as I can (1-2 payments a month). Those people call me night and day, morning noon and night! I finaly picked up on a SUNDAY afternoon and said "do you know what day it is???" The lady said a computer auto dails the numbers and that there is nothing they can do about it. I told her I made a payment for the month and I'll make another one next month. She asked when i made the payment (if to say there is no record of my payment on her computer screen). I told her and then I said not to call me on Sunday agian and to stop harassing me. She rambled something off her little script and then I hung up.

    How oten do they expect me to make payments? It sounds like even if I made a payment everyday, they'd still call me bcause my number is on an auto dailer..? Isn't this harassment??? What can I say to them? Please help, thanks in advance.

    Are you being contacted by the credit card company, or by a collection agency. If it is the credit card company, they will probably stop if you make at least your minimum monthly payment. If it is a collection agency, exercise your rights under the FDCPA.

    Thanks. I think it is a collection agency, but they make it sound like they are with, or part of the credit card company. Very confussing. I am making a minium payment each month, yet they call day and night, 7 days a week! The lady said a computer auto dails the numbers. <--- isn't that illegal if I am making payments?? Isn't that harassment?? I'm so pissed off right now! I wish I would win the lottery, I'd buy out all the credit card companies, wipe away everyones debt, and treat people fair!!!

    Your debt is apparently delinquent despite your making payments. You did not describe whether or not you are making minimum monthly payments; it also seems possible that this account has been closed by the lender.

    If it is a collection agency that is contacting you, exercise your rights under the FDCPA.
