My question involves landlord-tenant law in the State of: Virginia
I had intended to move into an apartment in Virginia with two other people. All three of us are named on the lease, but only I signed and turned in a lease, deposit, or rent.
The lease was supposed to start on the 15th of this month, but by the 18th, neither of my two roommates had signed the lease or turned in any deposit or rent, and I still didn't have a key to my apartment, so I called my landlord asking to get out of the lease and get my money back. It is now the 27th (I recently had surgery and was unable to get into contact with my landlord), and my landlord refuses to refund my deposit, and is even threatening to take me to court and hold me liable for all 12 months rent as stipulated by the lease.
My question is, am I liable because I signed the lease? All three of us were on the same lease, but only I signed, and I wasn't given access to the apartment by the date specified on the lease. Would the lease be considered incomplete and void because all parties named on the lease did not sign? And lastly, am I entitled to the refund of my deposit?
