    Default Gave Security Deposit, Signed Lease, then Changed Mind

    My question involves landlord-tenant law in the State of: Illinois(Chicago)

    A prospective tenant signed a lease, gave security deposit then called the next day and said she changed her mind and wants her money back.

    I had deposited the money into the property security deposit account the same day.

    This person continues to call asking when her money will be returned. I told her I have to find someone to take over her lease, plus I need to make sure the check is not returned (it was a money order).

    My question is what are my rights to the money? She signed a lease, and put money down. I believe she is not due ANYTHING just because she wasted my time.

    By the way.. her excuse for changing her mind was that someone in her family is sick in a different state????? I have heard it all.

    Your rights depend upon what provision, if any, is included in the lease for early termination, the start date for the lease, the efforts you're making to secure a replacement tenant, and if you in fact do find a replacement tenant (and when that occurs relative to the start date). You need to follow your state's laws relating to any portion of the security deposit you attempt to retain.
