    Default Public Urination Charges

My question involves criminal law for the state of: Massachusetts

To make a long story short, I had just arrived at the beach with some friends on the fourth of July. I had to urinate excessively bad, so I went in the corner of the parking lot that we parked in. There was nobody around me for 1,000 or feet or so ... except a state trooper that was hidden across the st in a median. I urinated, he came up to me all po'd thinking that he was about to get me for a DUI. No alcohol was involved. I wasn't arrested or searched or anything, but I was told that I was being cited for "indecent exposure" and that I would receive a summons in two weeks. It's been almost three weeks since, and I haven't received anything. My mail goes to my permanent residence, although I don't live there. They said they store everything that comes for me aside, but I'm not sure if they've missed it, or if it was never sent? ::nerveracking::

Who do I go to, to see if there were charges filed for my case, and whether I have a court date or not? I just don't want to miss it if I do, I have an attorney lined up if I receive it, but he told me only to call him if I actually end up getting the thing. I'm getting nervous!

    Thanks in advance.

What beach if you don't mind saying? I would call the clerk's office in the county in which it occurred and periodically run your name. Your attorney will likely be better received by the clerk's office with periodic calls.

It was at the Salisbury MA State Reservation. Thanks for the reply. I've arranged to meet my attorney this weekend, and we've already agreed to a retainer fee.

However, if he calls and there isn't a summons, do I still pay the retainer even if this never goes anywhere and I don't need to go to court afterall?

If that's the case I'd rather call periodically myself.

    Thanks for the advice

If you don't want to retain a lawyer unless the summons is actually issued, you can indicate that to the lawyer and determine what the retainer will be if and when that happens.

Yeah, I have a 100% clean record before this. If they never summon me, then I have absolutely no need to keep him. I was debating fighting this myself, but my criminal record is too delicate to risk. I will use him if I get the summons for sure. If not, hopefully I'm smooth sailing! I am going to call them in about an hour.

I called the Essex County Superior Court today, and they had no court dates for me. He prompted me to call the Essex County District Court. I had to leave a message, they didn't answer. In hindsight, it makes more sense that it would be in the district court, if it existed at all. What do you think?
