Sex with a Minor

My question involves criminal law for the state of: Georgia

3 years ago my 25 year old son had sex with a girl that was 15 she lied about her age saying she was 19 her parents found out and took her to the local police she made a statement. No charges were ever made. She is now 18 and has contacted my son wanting to go out my son told her not without her parents permision she has aparently asked her parents and they are now saying they are going to press charges. can this be done?

Your son should have had the sense to say "no".

With the passage of time, the chances of a prosecutor being interested in picking up the case go down, but as long as the statute of limitations has not run a prosecutor can authorize charges.

I agree even though she looks 25 and her facebook page stated she was 19 we are living in a world where u need to ask for two forms of ID

For what it is worth, the girl could have sworn she was 30.

It was up to your son to validate her age before he slept with her.

Georgia does not allow the lies of the child to be an affirmative defense.
