    Default F-1 Visa for a High School Student and Legal Guardian

    I have a friend in another country who wants to have their high school aged child study in a private school here in the US.

    The school has accepted the child and is accredited by the USCIS and the family is financially sound - so obtaining the visa should not be a major issue. The issue that has cropped up is whether or not the child requires a legal guardian in the US to make emergency decisions or to sign releases for the child.

    Additionally, the person who my friend has selected to take care of the child while in the US is herself in the US under an F-1 visa. Are there any problems or official legal processes/paperwork that my friend needs to deal with, or is this something that a signed release between the two parties will suffice? Is the fact that the caretaker is not a US citizen be a problem? Any resources or tips would be really helpful!

    The issue has cropped up with who? The school? You will need to address the school's concerns with the school. If we're talking about the school, and the school will accept your grant of a medical power of attorney to the person with whom the child will be staying, executing such a power of attorney should resolve the issue.

    Thanks for responding.

    It's not the school who is concerned, but just something that was a concern to the parent. She won't be in the US so she wants someone to be able to make emergency decisions.

    She wasn't sure whether or not she has to register anything with the state or government or if an signed agreement between two parties was enough. From what you've said, if the school is willing to accept an agreement between the two for medical power of attorney, then things should be OK? Is this something that hospitals and state agencies will honor as well?
