    Default Landlord Passed Away - Who Do I Pay Rent to

    My question involves landlord-tenant law in the State of: CA

    I live in a converted pool house of a woman (landlord) and her mentally handicapped daughter who live in the main house.

    While I was out of state working on a job the woman passed away.

    A man came up to me the other day and said he was in charge of the estate now and wanted me to pay him the rent. He did not show me any legal documents stating he was the executor so I did not pay him anything.

    I have not seen or heard from any other family member except for the daughter who is still living in the main house.

    Who should I pay rent to and do I still have a contract?

    is this even a legal unit?


    anyway, you would pay whomever is the administrator or executor for the estate. Do not believe a person that does not have official letters of administration or letters testamentary or can somehow prove they are in the position to act as they are.

    Until a person does have that position, there is likely nobody to pay rent to. In that case, I would take the rent payments and open a separate bank account to place them until a person with authority comes knocking.
