    Default Handicapped Parking in New Jersey

    My question involves a traffic citation from the state of: NJ

    I received a ticket in the mail for being illegally parked in a handicapped area.
    I live in Glassboro, NJ where a local vigilante is allowed to issue citations.
    I had a valid state placard displayed, (it was torn so I could not hang it) it was on dash.
    I also have a ID card in my wallet.

    My vehicle is also equipped with a Wheelchair lift on my rear tow hitch??

    Am I liable for a fine?

    I am on oxygen 24/7 so it is hard to get around.
    What do I do, the fine is in excess of $200.00
    Thank you.
    PS I am former Law Enforcement...sad but true...officer of the court.

    This is under ordinance 445-34?
    Quote Quoting Glassboro Ordinance, Sec. 445-34. Parking spaces reserved for the handicapped.
    A. In all parking areas in the Borough of Glassboro which are open to the public or to which the public is invited, no person shall park any vehicle at any time in any parking space which is marked and/or signed as a reserved space for handicapped persons, unless the driver or a passenger in said vehicle is actually handicapped and such vehicle bears the certificate, insignia or license plate issued by the Director of the Division of Motor Vehicles for handicapped persons, designated in Title 39 as "amputees."



    B. Penalties. For a violation of this section, the offender shall be liable to a penalty of $284 or imprisonment for a term not exceeding 15 days, or both.
    It would seem you can attempt a technical defense, in that your vehicle did "bears the certificate" entitling you to park in the spot, albeit in a less than ideal location to be seen by somebody who is enforcing handicapped parking spaces.

    In the meantime, I suggest either replacing your hang tag or taping it such that it functions adequately.

    It has to be hung .. not simply placed on the dash. Oxygen issues or no, you will be found guilty IMO.

    I have been in a similar situation in New Jersey. I was transporting a handicapped person and the meter officer didn't see the placard. I went to court and showed both the placard and the ID and the judge dismissed the case.

    I would suggest going to court.
