    Default Marriage Tourist Visa to a U.S. Citizen

    Hello, could you answer the questions please. Are there any requirements and documents (except passport) for both spouses of this marriage? How long after wedding the tourist will get visa that she/he can legally stay and work?

    How long after the wedding will the application be filed?

    It can be as little as 3 months to receive a temporary work permit, or over a year. Much depends on the location, too.

    (Which you didn't mention)

    Also, is the person here on the Visa Waiver Program? If so, how long has s/he been here?

    the application will be filed next day after the wedding. the location is Los Angeles. the person here on tourist visa for 3 weeks.

    You're getting married while the person is on a 3 week tourist visa?

    You will be getting married while you're on a 3-week tourist visa?

    yes, many people get married this way. i have 2 years tourist visa, but officially im going to stay for 3 weeks. my visa works till october'11

    What you are attempting to do may be considered fraud.

    Get married. Return home. File for immigration processing in your home country as the spouse of a US citizen. There will be no issues relating to entry with immigration intent (as evidenced by fast filing after entry for AOS) if that is the procedure used.
