    Default Caught on Camera

    My question involves police conduct in the State of: Arizona ( Lake Havasu, Mohave County)

    Ok well we were at Hastings and we gave my son a golf Frisbee thing to hold because it was colorful. Well he didn't want it, and dropped it into the cart. We put the diaper bag in there and forgot about it. When I found out we accidentally stole somethingI thought that I can try to return it for store credit and everything would be fine. Well turns out when i tried that, the computer showed that the store has never sold that item. So she returned the item to me, in which I took it and left. After that had happened the worker apparently reviewed the security tapes and saw that my wife gave my son the toy and he didn't want it so it fell into the cart im assuming because all she said was I saw your wife hand it to your toddler and then you walked to the back of the store. And that she filed a police report. I want to know what are the chances that the police are going to pursue us, because they have my wifes name. If they do pursue us, will they do it by a call and ask us to come down to the station. Will they come to our house? And my wife wants to be a nurse, so she can't get in trouble. So if they do try to arrest us, can I say that my wife was unaware of the theft and it was solely my responsibility? If so what am I looking at for a first offense. Should I ask them to give me a lawyer? Or do the ones they give suck? Just any advice would be great guys.

    So let me ask this.....you guys left the store with the item, then tried to return it for a store credit? Sir, you already stole the item, now you want money for it, too?????

    That blows the whole "it was an accident" excuse all to Hell.

    Yes, the police can come knocking on the door. Yes, your wifes nursing career can be ruined. They do not want shoplifters handing prescription drugs that can be sold on the street...and they don't want a shoplifter near unconscious/bedridden people's belongings.

    As soon as the police come knocking, you will need a Criminal Defense attorney.

    Well, like I said. It was an accident. My wife had no intention on steeling it or returning it for credit. She thought that I just tried to return it to the store.

    Well, the item did make it out of the store. HOWEVER...when returning it to the store, you attempted to get store credit, for an item which you/your wife HAD NOT PAID FOR.

    You can face two charges: Retail Fraud and Return Fraud.

    Having worked retail, yes it is possible to accidentally steal something. But you return it right away, explaining the situation. You don't try to return it for store credit, as if you had purchased it.

    Where did the word "store credit" come from or was that a Freudian slip?

    If you typed "When I found out we accidentally stole something I thought that I can try to return it to the store and everything would be fine."

    Then I would understand.

    I have a feeling that they may be contacting the higher ups and may plan on the more serious charge as Pandora explained if you did try and get a store credit. All involved will be accessories to the crime.

    Why do you think you were due store credit for successfully stealing a toy?

    I could've swore I just saw this "story" on one of them World's Dumbest shows. Or maybe not! 'Accidents' happen all the time I'm told!

    Accidents can happen. I've worked retail.

    A similar situation: A woman got to her car, found an item had fallen under her baby carrier.

    However...she brought it right back into the store, and apologized. No LP after her or anything, she brought it back on her own.
