    Default Landlord Refused Rent Payment

    My question involves landlord-tenant law in the State of: California

    I paid my rent with a check that had my prior surname on it even though the account name has been changed. Although not often, I have used the checks before and they have been honored by my financial institution. The property manager sent the check back to me. I called and explained so they said ok, mail the check back. When they received it they called asking me for a copy of my marriage certificate! I refused - none of their business. They said they had a right to know who lived in the apartment and I told them that my husband was on active military duty and not living with me - they confirmed this with the on-site manager. A couple of days later they taped a 3 day notice on my door and have not returned the check I sent them. What should I do? I have never been late on my rent and have never been served an eviction notice. The apartment building was recently purchased by a new owner - are they trying to force me out for higher rent?

    They wanted your marriage license to confirm that the check was yours, not a third party check? That's understandable.

    Many landlords and other businesses refuse, as a matter of course, to accept third party checks.

    You can pay your rent as instructed. If they fail to return the other check you can consider stopping payment on it; if in fact they deposit it and it clears, the amount will be credited to your rent.

    Er, no. Marriage is a public covenant. The fact of your marriage is a matter of public record that anyone can go look up at the court house.

    Concur with Mr. K - they were not out of line in asking for this in order to confirm your identity.
