    Default Homeowners Association Restrictions on Parking by Owners

    My question involves towing laws for the State of: Alabama

    This afternoon I was approached by a member of the homeowners association of our neighborhood and informed that it was illegal to park on the street and if I persisted that my truck would be towed. I live in a subdivision on a cul-de-sac and in the back of the house I have a driveway that is shared with 4 other houses. Only one vehicle will fit in my portion of the driveway and we are a 2 car family. We have lived here for 7 years without a problem, then last week the homeowners association put up a sign at the entrance of the neighborhood stating "No Parking on Street". According to the homeowners rep it has always been in the bylaws but after 25 years they have finally decided to enforce it. There has never been any paperwork or agreement that I have been asked to sign confirming my compliance to the covenant. According to them I automatically agree to the covenant bylaws when I moved into the neighborhood. The only other area I can park my truck is in the yard (which is very tempting just to irritate them) but I am a little to particular about my landscaping. My question is do they have any legal ground to enforce this neighborhood bylaw even though I have not officially agreed to the terms of the covenant?

    Your commitment to obey HOA rules is probably right in your deed. Take a look and see.
