My question involves child support in the State of: TEXAS
My husband carries insurance for his son as he is the primary custody parent. We have costly medical bills that we have paid in full for his son---which we gladly do, and are financially able to do. But now biological mom owes us half of the expenses.
We notified her and asked her to come to consultation appts & appts for these procedures to discuss splitting the bill--she did not respond nor did she show up to any of the appts. The court papers between the two of them state; my husband has 10 days to notify her of all expenses and present her with reciepts, explanation of insurance covered amts as wells as out of pocket amts--which we did. She has 10 days of receiving the information to pay these bills either to the dr office or reimburse my husband if he paid in full-- we sent two emails and a thrid to see if she had received any of the information. Now, she wants to pay a small amt each month for the next few years.
My question is... Do we have the right to ask her for full payment (going by the court papers)? We did not agree on a payment plan ... this is what she told us what she was going to do. We have not recieved a payment as of now.
And would it be worth it to take her to court for this?
We anticiapte more medical bills to come and its not getting any less expensive.
