    Default Company Had Huge Contest, Won, Denied Prize

    My question involves employment and labor law for the state of: Texas

    My retail employer held a nation wide contest. The top 5 store managers with the highest percent over last years signature platforms during the month of June would win an all inclusive trip for 2. I came in 2nd and posted online I was in the top final winners winning the prize. Well, my employer has denied me the trip. They told me, regardless of the contest announcing all stores and store managers were participating and announcing me a top winner, I could not go. The trip is easily worth $4000. I worked so hard to win this contest, watched myself climb up the scale over 2000 stores into the top 5 through the month of June, and on July 1st, after being considered a winner, they called and told me I was not eligible.

    I'm upset and no on in the company cares. I called HR, district and regional managers and they all are avoiding me.

    I spoke to a lawyer and he basically told me if I took action, I would more likely be fire.

    Is there anything I can do? In my job we work off commission, bonuses, and contest. Here I won something fair and square, and get nothing.

    If anyone has any advice on how I can handle this, I would really appreciate it.

    They told me because I am a store that sells only cell phones I was at an unfair advantage in the signature platforms. That even though I nearly double signature sells by 95% from last June didn't count. But I am considered a store, and the contest showed all stores. They never once said the contest excluded any certain type of store in the company.

    And in my mind, a store with more things to sell has a better advantage to rise their profit. So their excuse is insulting.

    Everyday through June they showed the MTD results, and I was on there. Even now with the final determined winners, I am still announced the winner, they just are denying me the trip. Then they said, well.. we could try to get you an IPAD, which never happened either. A near $4000 trip taken away to bribe me with $600 IPAD to not 'feel bad' and now nothing.

    well, I suspect you have a choice to make:

    accept whatever they give you and move on

    make a huge issue about it and maybe get your prize but most likely injure your relationship with your superiors and possibly lose your job.

    Which do you want to do?

    I am looking for legal advice. Yes, I want to fight this or I wouldn't be seeking advice. And even if I lose my job, at least I stood up for my rights. And injurying my relationship with them is not my concern. They are the ones who told me all the money I put in to throwing events at my store, promote our through store and college events, all the hard work and drilling my employs until they are the top employees in the region is worthless.

    If there is any legal action I can take that you can share with me I would appreciate it.

    Great advice was offered twice, once from a lawyer you called/seen in person and once on this forum.

    If you make waves, you will lose your job, over what, a $4000 trip? Not worth arguing in my opinion, but it's your call.

    You don't have a legal action to take.

    was this money spent on these events out of your pocket or was it company money? Was this typical to spend your money (if it was) to undertake such activities? Was this known and approved by your superiors?

    I agree with those who told you that filing litigation is almost certain to result in the loss of your job. jk seems to be suggesting that they may research for grounds to terminate you; but odds are you're at-will and they don't need grounds.

    We're not in a position to review the publicity surrounding the contest, or whether or not you could infer from the information or rules that were available that your store was or was not eligible. We simply don't have access to the information. It's possible that you could be able to make a legal case; it's also possible that you would lose your job and later lose your case. If you want to pursue this I would suggest consulting your lawyer with the details, while keeping in mind that it's easy to run up a $4,000 legal bill long before you collect on a $4,000 claim.

    Right, and if it cost you $5000 to win $4000, there is only one real winner in this case - your lawyer.
