    Default Evicted Tenant May Have Moved Out; when Can I Enter Unit

    My question involves an eviction in the state of: NJ

    Last week, I went to LT court to evict tenants who are 3 months behind in rent but they didn't appear in court. They haven't been served with the warrant of possession yet but I think they may have moved out. Last week, they were seen throwing out mattresses and over the weekend, they were seen moving a lot of things out in the middle of the night. They've told me countless times they were going to move out but they never did. I think they may have moved out without notifying me b/c they're spiteful and didn't want to do a walk-through (I have no idea what condition the apartment is in).

    When would it be safe for me to enter the apartment? I was concerned that they may have left a faucet or something running so should I enter it immediately? Do I need to give notice?

    A landlord has the right to enter and inspect upon reasonable notice (24 hours is normally deemed reasonable in the absence of an emergency that requires shorter notice, or entry without notice) or if the landlord reasonably believes that the tenant has abandoned the premises. Outside of an emergency or agreement, entry should normally be during normal business hours.
