    Default Original Landlord is Evicting a Subtenant "Immediately"

    My question involves landlord-tenant law in the State of: Massachusetts

    I am a subletter who was told today by the original landlord that I am being evicted effective immediately. There was an issue with the neighbors complaining about our trash smelling and was reported to the landlord. The landlord then called the tenant I am subletting from (let's call her Brittany) and told her that she needed to fix this situation or she would be fined and there would a be termination of the lease. Upon this conflict, the landlord realized that the entire apartment was occupied by 3 subletters and 0 tenants, which was a breach of their original contract stating there must be at least one tenant at all times. Also, I signed a contract with Brittany that was not signed by the landlord (and anything related to the landlord was crossed out by Brittany). The landlord allows subletters but Brittany did not make me aware of the one tenant minimum rule. So, because Brittany breached her contract with the landlord, what legal steps does the landlord need to take to evict her? Can it be immediate because of the breach, or does the 30 days notice in writing still stand? What are my rights in this situation?

    Read this. Assuming the master tenant is not claiming to have abandoned the lease, it looks like your landlord has to provide thirty days notice for an eviction over the violation of a lease provision.

    You may have a remedy against your landlord (the master tenant) if that person's violation of the lease results in the termination of your tenancy.
