    Default What is Enough for Me to Get Emancipated

    My question involves emancipation laws for the State of: Tennessee

    My mother and step father are severe alcoholics and drug addicts. I have 3 step siblings, and we have another kid of the way. Living with my real father really isn't an option, though i wish i could. My mother screams at me constantly, telling me she'll throw me out on the streets, has neglected me my whole live to the point where i didn't see her a few days at a time and we lived with a heroin addict because she got kicked out. My house i pretty broken down. We have black mold everywhere. They cannot pay the bills, and out water and power shuts off frequently. They can't pay rent and we're looking towards getting kicked out again. I am mentally abused, and they don't deny it. They tell me to do things to get on their good side, and they'll help me for "battles" to come. I know a few jobs i can work at. I also have a friend who is already emancipated that is willing to be my roommate. Is it possible that when I turn 16 I can be emancipated?

    There's no need to make repeated posts.

    You simply don't qualify for emancipation. If you're being abused or neglected you can call social services.

    I get it. You don't think I qualify. That's fabulous. I was wondering under different circumstances if it would be acceptable. Please try not to be so blunt on this forum, it's quite rude.

    Any convictions or recent arrests to back that claim up?

    This is an allegation made with some frequency by ex husbands and wives, and sometimes by teens that seek to impose their will against parents who are somewhat controlling, so do not be surprised if no one you speak to will take your word for it on it face value.

    Why not? If he has not had his parental rights removed, and mom is not up to the task, he can seek custody.

    But, if what you want is to stay where you are and hang with your current friends, and dad lives somewhere else, then of course it makes sense why dad would not be an option. So, why is dad not an option?

    If you and your sibling are being abused or neglected, you need to contact child services, the police, a school official, a counselor, or someone who can get in touch with the authorities to help. Emancipation will not happen, but they can provide you a safe place to stay.

    Being abused or neglected does not make you a good candidate for emancipation. Very few teens who apply for emancipation ever receive it, and these tend to have exhibited responsibility, maturity, and need.

    My step dad has been to jail a few times in the past two years, the most recent being about 3 months ago. My Father has had to pick my mother up from jail a lot, but that was probably 7 years ago, I don't think that's recent anymore? I'm not sure.

    It's not about anything like that. He doesn't want custody of me, and couldn't provide for me if I did live with him.

    I'm considering that, I was just hoping I could live on my own, I'm not sure what they'll do with me or my siblings if we contact them.

    No, you cannot live on your own without your parent's permission.

    I still recommend talking to social services if you want to fix the problem at home.

    Emancipation is a very unlikely option here. As has been mentioned, contact social services/child services for assistance.

    The circumstances are immaterial. As I told someone yesterday on another forum, your mother could be beating and starving you, and have kicked you out of the house in a blinding snowstorm in nothing but your underwear, with you pounding on the door to be let in and her laughing at you through the letter drop, and you STILL would not be emancipated if you didn't meet every. single. one. of the qualifications. You might be put into foster care. You might be put in a group home. You might be placed with other relatives. But if you do not qualify for emancipation, then it doesn't matter what the circumstances are, you won't be emancipated.
