    Default Non-Selection for Promotion - Resolution Options

    Hello, I am a federal employee and have brought an EEO complaint for gender discrimination against my agency.

    The evidence is pretty strong for me because they selection committee for the promotion has repeatedly said that their decision was based entirely on "what they knew" about applicants, and they never reviewed any documented credentials or conducted interviews. So there is zero documentation. And I was miles ahead of the male candidate who was selected for the position, by far.

    Anyway, long story short, is that the investigation is now underway. I really want to settle this, but the only thing I want is that job. It wasn't just any old job; it was THE job I wanted. They can't take it from the guy who got it, so what does that leave for me as options? I don't want money. The only thing I wanted they can't give me. I have been sick with stress over this and want it resolved.

    If the only thing they can do to "make it right" by your measure is give you that job, and they can't give you that job, there's no way they're going to be able to "make it right".

    right, but what could get them close? I'm not trying to be daft here. I just don't understand how they make something like this right? I need some range of reasonable things to ask for, particularly non-monetary ones (although obviously I'll want back pay).

    If you prevail, they might be able to offer you a promotion to a position with a similar compensation package and a level of responsibility similar to the job you didn't get.

    I will say that a clear understanding of both what it will take to make your whole and what the company can reasonably do is vital.
