    Default Released from Prison and Now Have a Huge Amount to Pay, How Can I Have This Forgiven

    My question involves child support in the State of: California

    i was just released about 18 mos ago from prison. i have 3 children that were receiving public assistance during the 5 years i was in prison. When i got out of prison i went to get my drivers license and was told it was suspended. Due to Child support payments not met. i went right away to get this clarified and tell the Child Support office i was in prison and they told me i owed $80,000.00 and this could not be forgiven. In order to re-instate my DL i had to pay $400.00 and then go to court and have an arrangement set up and the mother was there as well.

    As of today my balance is $137,000.00 since i am only able to pay $400.00 a month and the mother did close the current case. Can anyone point me in the right direction to see what can i do to have the $137k forgiven and maybe just start a new child support order and pay $400.00 from this day forward. I am desperate, i only make minimum wage any advice with this will help me so much.

    How much do you owe the State? $80k or $137k?

    when i was released i owed $80,000.00 which was 18 months ago. As of today (18 mos later) i now owe $137,000.00

    All you can do is try to negotiate. The State isn't going to wipe the arrears though - it's not in their interest to do so.

    Even if you have to move in with friends/family, work 3 jobs, you've really got to try and make bigger payments to get those arrears down.

    If all the arrears are owed to the State for public assistance reimbursement you can apply for the 'Compromise of Arrears Program'. This program does not wipe out 100% of the arrears but if you qualify it can wipe out a lot of what is owed. This situation is something that should have been taken care of when you first became incarcerated. In California, for the most part, once you are incarcerated the court can set ongoing child support at zero, but again this is something you needed to request back when you first became incarcerated. The court will not go back to do this so the 'Compromise of Arrears Program' (COAP) is worth checking out. There are specific eligibility requirements so not knowing all your facts there is no way of telling if you would qualify but its best to check it out. Just contact the local child support agency that handles your case and ask for information and/or an application for the 'Compromise of Arrears Program (COAP)'.
