My question involves small claims court in the state of: FL
Wedding photographer paid in full. Couple of weeks before the wedding husband was deployed and had to cancel with all vendors. Photgrapher said they understood and said they would gladly apply the money to new date. Upon husbands return requested new date and photographer responded they would be glad to do the job however approx two months after we cancelled they moved to another state (never told us) and they now want us to pay for their travel expenses and a price increase they had in the meantime - which over doubles the origianl cost - otherwise no credit or refund. Not willing to negoiate or even do a partial refund either. Contract states no refunds for any reason - however by offering us a new date in writing doesn't this revise the contract? Where would I have to file the lawsuit? In our county? In the county they previously lived in in this state? In their new state where they moved the business to?
