    Default Shoplifting in Sears

    for a 18 $ goods i was caught in SEARS , I walked out forgetting to pay for it although i paid for 75$ goods from the same shop, they made me sign 3 papers, one that i am not allowed to get into sears for one year ,and the second one is my profile and the goods and their price,and the third one says that i will recieve a letter from their law office... I had no ID card with me so they said that they have to call police to identify me, although they were unwilling to raise charges. SO one police man came and arrested me and took me to the police station,where they took my fingerprints and my photo.I paid 40$ and they let me go with a paper saying that i have to be in the court ( Holyoke,MA) the next day morning...and there I told the court attorney( which they assigned for me) that i will do anything which prevent this from appearing on my record( coz i am looking for a new job) and he said we will ask them to convert it from criminal to civil, and by that it will not appear!!!
    the judge asked me if this my opinion, and i said yes ... i paid 25$ fine and they said you are free to go...

    The question is,will it appear one my preemployment check? and will it affect my ability to have the job ? will my employer see it? the attorney said he will see that it was converted to civil,is it good? will he see the word : shoplifting :?

    No ID? I find that incredibly odd. Just out of curiosity, why didn't you have ID?

    simlpy I forgot it in the house ,in another shirt ,befor leaving.

    Perhaps you should get clarification of this from your lawyer.

    If you wish for more clarification here, at least from my standpoint it would be helpful for you to describe the exact civil charge to which you pleaded guilty, along with a citation to the relevant statute or ordinance.

    they wrote that it is a 'shopllifting by asorption' c226#30A ,...and I was 'decriminized'(227#70c)

    Those citations reference what? Chapter 226 of the General Laws of Massachusetts pertained to bail, and has been repealed.

    I believe Mike 22 meant Chapter 266: Section 30A. and Chapter 277: Section 70 C.

    If the matter was resolved as a civil infraction, while the arrest might show on a background check, the conviction charge would be at about the same level as a traffic ticket.
