Custodial Parent Paying Child Support to the Non-Custodial Parent

My question involves child support in the State of: VA and IL

The CP and NCP live in different states, currently only have a verbal agreement in place that NCP pays 20% of net income each month, except summers when the child is in NCP's care. CP covers half of the child's travel exepenses during summer and every other major holiday visits. NCP thinks that because CP makes more money thatCP should pay the NCP child support during the times the child is with the NCP. Can the CP be ordered to pay the NCP support during the summer and every other major holiday that the child is in the NCP's care?

Most courts have a set support system that allows for support every month of the year despite some minor changes in residence (e.g., spring break visitation or three weeks in the summer). The courts actually take that into account as they make the order. The first thing you need to do is get an order in place and determine which state will have jurisdiction, which will probably be the location the child was born. Once a jurisdiction is determined then the mandates of that state will apply.
