    Default Summer Schedule is Consecutive 3 Weeks Plus Regular Visitation

    I thought regular visitation schedule is not included in summer schedule........... He insists that he has 3 weeks visitation PLUS regular visitation( wednesday, friday and saturday on every other week)
    I am very confused...... And I already made plan for trip but now he force me to drop kids on regular schedule days. I am in panic now!!!!


    Here is our agreement

    The HUSBAND shall be entitled to exercise custodial privileges as follows:

    1) Every other weekend from 6pm to Friday until 8am on Monday. On Mondays when there is school, HUSBAND is to arrange for children to be transported by him to the school at a time when they can be left there or he will transfer them to WIFE on Sunday night at 8 30PM. so she can transport them to school. If the HUSBAND is required to work on Saturday, his weekend visitation shall begin when he finishes work on Saturday, rather than on Friday evening.

    2) During the Easter holidays of even-numbered years and during the Thanksgiving holidays of odd-numbered years.

    3) During the Christmas holiday from the time the minor child is/are released from school until 2:00pm on Christmas day during even-numbered years and from 2pm on Christmas day until the minor child returns to school during odd-numbered years

    4) On the minor children's birthday as may be mutually agreed upon between the parties

    5) For three weeks during the summer, two of which may be consecutive. HUSBAND shall notify the WIFE by April 1 of each year of the three weeks he will exercise. HUSBAND's summer visitation weeks shall run from 6pm on Friday until 6pm on the Friday concluding the visitation period. If two consecutive weeks are exercised, they shall begin on one of HUSBAND's regularly scheduled weekends

    6) Every other Wednesday from 5:30pm until 8am the following the morning.

    It clearly states that "If two consecutive weeks are exercised, they shall begin on one of HUSBAND's regularly scheduled weekends", therefore his regularly scheduled weekends are clearly still on going and the three weeks are in addition to them.

    So husband should choose the consecutive week of regular schedule? I mean He needs to watch kids on August 5th 6th and 7th for regular schedule. He needs to pickup this week for consecutive week ( 2 weeks?) Or he can pickup his favorite week ?

    I'm not certain that I understand what you are asking, but basically, if you were to exclude the summer parenting time for a moment, then your ex would have every other weekend visits. On the calendar, if one of those weekends falls on Aug. 5th through the 7th, then he would pick up the kids to start his two consecutive weeks on the 5th and you would get them back at 6pm on Aug 19th.

    Thank you for your advice. So If he takes kids from July 15th to 29th, No regular schedule on August? (Wed, fri, sat, sun on every other week?)

    Ah I see now.

    Because your court order specifies an ending time and day for his two week parenting time, my interpretation would be that if he takes the kids from the 15th through the 29th, then no, he would not additionally get the weekend of the 29-31st. However, in the spirit of "every other weekend", he would get the children on the weekend of Aug 6th and every other weekend after that.

    But I'm not a lawyer.

    However, I am a CP who has gone through similar situations and debates, and my non-legal advice is that you have two options: you could stick to the letter of your court order which says that you would get the children back at 6pm on the 29th (and he would then get the kids on Aug 6th) or you could give him the weekend of the 29th for the sake of consistency and cooperation. The underlying question that you have to decide is is this really worth arguing about?

    Ok Thank you so much!! Your help means a lot to me!!!
    I don't have straight 2 weeks vacation with kids because of the regular schedule.
    I gave him one more extra Consecutive week in August so that he can switch the regular day that is when my kids have tae kwon do blackbelt ceremony. I gave up many days to him for kids's important ceremony.
    Hope he can accept my offering and everything will be smooth.
    But he ignored some of court order. I told him not to write email in Japanese, but English, but he ignored this and wrote me in Japanese and said verbal abuse words. Also, court order says he needs to recalculate the his incomes and need to change child support ammount on every 6 months, but he never does it.... I don't have good knowledge about court order law, but I feel he uses me......
