    Default Immigration and Entry on a Tourist Visa After Marrying a Permanent Resident

    Hi,

    I'm a permanent resident and I'm married to a girl from Brazil with a B2 Visa. She lives in Brazil now but we want to live together in the USA.

    Once I file the I-130 for her, can she still enter the US for short visits with her B2 visa or will she be denied due to clear immigration intentions?

    Since we got married she entered the USA a few times already with her visa and left after two weeks with no problems.

    A B2 visa is a non-immigrant visa, so entry on that visa would be inconsistent with having previously declared an intent to immigrate.
