    Exclamation How To Determine Your Status

    I entered to US with my I-94, got married on December 2010 and filed for I-130 on January, my I-130 was approved on June 9th, but my I-94 just expired one week after my approval, we filed using the address on USA as my currently address, so they know Im here. Do I have to leave the US to continue all the paperwork? What is my status? Am I in a big problem? The legal assistant that helped us with my I-130 told me that I'm ok cause I'm in process and the government knows that, but my NOA said that I'm not eligible for adjustment of status and need to do everything with NVC, what is the better way to do it?

    Is the legal assistant working for an attorney in a law firm specializing in immigration issues? If not, find yourself an attorney specializing in family immigration. The fact that you say you are not eligible for adjustment of status and are in the US takes this out of being a typical case.

    Do NOT wait hoping for the best. Since your I-94 has already expired, you could be accumulating illegal presence which could prevent you from returning for years if you are required to leave for processing,
