    Default CVC 22350 55mph in 35mph zone

    Hello, I recently got a CVC 22350 speed ticket in El Segundo, California for doing 55mph in 35mph zone. The court is Inglewood Court House. It has been quite a while since my last ticket. I have a some questions:

    1. For my speeding ticket with 20mph over speed limit, am I eligible for traffic school? How many mph over speed limit before you are no longer eligible to go to traffic school?

    2. Does the fine vary depending on how fast I was going? Is the fine 20mph over speed limit much more than 15mph over speed limit? I'm curious on how the speed ticket fines are calculated.

    1. That will be up to the magistrate/judge.

    2. Yea the fines vary in a lot of cities. But they will equal the same amount of points in CA. It will be best to call the number on the ticket and ask how much the difference is.

    22350 is one point on your DMV.
    (I believe it's 4 points within 12 mo. = suspension)

    Many Judges won't give traffic school when it's 15 mph over; others use 20.

    It doesn't hurt to ask.

    You can set it for trial & if the cop doesn't show, the ticket will be dismissed. However, most Judges won't give traffic school after you request a trial.
    Ask the bailiff or the court clerk, before court convenes, if the Judge will give traffic school.

    They do allow traffic school, even after pleading guilty and losing, in my county (also California). You can either ask a clerk or observe a court in session and you'll quickly find out. With '20 miles over', I wouldn't jeapardize that opportunity, if I were you.

    As far as being eligible, you can check out California Rule of Court 851(c) which clearly spells it out. If your infraction carries more than one point or if you exceeded the speed limit by more than 25MPH, you would not be eligible....I think you'll be alright as long as there are no other factors (i.e. commercial license, attended within 18 months, drugs/alcohol involved).

    Traffic school is up to the discretion of the Judge;
    Judges within a county differ.
    L.A. county has over 40 diff. judicial officers sitting in traffic courts.

    Judges have a certain amount of discretion if the violator is eligible. Otherwise, the law is very specific...if you're not eligible, you're simply not eligible.
