    Angry Can a Minor Who's Approved and Now Over 21 Get a Green Card

    I applied for my sister and her family for greencards and they were approved after 10 years (I-130). Her only son was 18 when I applied in 2001 and the application was processed approved. It is 10 years later, NVC has send me an AOS and application for both my sister, her husband and her son (who's now 28 years old and unmarried). I paid the fees ($88 and $404) for all three of them but I am uncertain if he can get a visa since he's an "unmarried child over 21" now ?? Should we proceed with his application ? futile or am I misunderstanding the law?

    I appreciate your response and time regarding this matter.

    You appear to indicate that the (former) minor, now 28, has a Green Card. Why, then, does he need a visa? Did he move out of the U.S. and abandon permanent residency?

    Default clarification for minors !!!

    Thank you for replying to me! TO clarify, I didn't mean Visa, meant permanent residency. My sister and her family (husband and son) have never had a visa or set foot in the united states. I simply applied for green card for them about 10 years ago. Like you elegantly stated, the former minor, now 28, has been approved for getting permanent residency/green card. But from my understanding, since he is over 21 and unmarried, he can not come to United states with my sister and her husband??? he doesn't fall under child protection act?? true??? or am I way off????I'm confused because if he does not qualify why did NVC send a packet for him (requesting application completion/fee $404) just like my sister and her husband?? THank you for your help and sorry for the length of explanation!

    I think you're misunderstanding. If he was approved based upon the application you made 10 years ago, he'll be fine. His age now doesn't really matter - his age when the petition was filed is the important thing.
