    Default Financial Transaction Card (FTC) Fraud Charges

    So here's my question.

    I recently involved myself with the wrong crowd. One night someone who was with me had a stolen visa card he had gotten from someone and we went to a fast food drive through. I sat in the passenger seat and he ordered food and used the card etc. I went home. Later that night he was caught on tape at a gas station getting gas.. then the next day at a waffle house (note: I was not with him during the last 2) I also never saw the card nor touched the card.. I had a warrant for ftc fraud etc turned myself in as i'm a college student who doesn't know much about this sort of thing. Anyway, I got an initial appearance for july 20th.. Can i fight this charge since I never actually used it or can they still get me since I was indeed in the passenger seat. (the guy even said I had no clue about the card being stolen while at the fast food place)

    I know I was in the wrong but I'm just curious

    I believe you can fight the charge as you had no knowledge the card was stolen.

    If my friend treats me to pizza, how am I to know he stole the money a week earlier.

    They apparently have some evidence that suggests that you knew that your friend was using a stolen card, and that the transaction(s) for which you're charged were for the benefit of both of you. I expect that whatever evidence they have is described in the police report. Have you (or your lawyer) obtained a copy?

    Also, did your buddy take full responsibility and say you had no knowledge of the card being stolen. Or is he letting you come along and share the charges with him hoping it will dilute his charges.

    Are you telling us the whole story ?
