I work at an upscale hotel in California.
Earlier today the General Manager for the property where I work came into my office and asked me to fill out some paperwork for him. He then proceded to pinch me really hard on the arm. I advised him that his action was assault and that I had the right to defend myself. His reply was "please do". It was all I could do to not sock him in the nuts!
Instead, I decided a more prudent action would be to take the matter up with Human Resources, which is what I did. There was a witness to the incident and we both filed a report with HR, who took notes on a legal pad because she didn't know where the proper forms were kept. My questions are: Is this Assault and Battery and if so, should I involve law enforcement or procede through company channels or both?
A pinch on the arm isn't really a big deal, but I would say in this case it is kind of a big deal... especially when followed by an attempt to incite me to violence.
