    Default What's the Fastest Way to Evict a Subtenant

    My question involves an eviction in the state of: Illinois

    We have a 3 bedroom apartment with 2 roommates and recently had a subletter move in for the remaining 6 months of our lease. In our initial subletter agreement, we stated 1 month of security deposit payable upon move-in as well as 30 days move out notice to terminate agreement if rent is not paid.

    Fast forward 2 months, our subletter has not paid this month nor do I think he has money for next month- meaning that we are short somewhere to the effect of $1200 At the beginning of this month, my roommate has said something to the effect of "If you can't afford to pay rent, you really have to leave." but our subletter has made a ton of promises to deliver rent (a week ago, a month ago, etc.). Does this constitute a verbal termination of agreement and therefore he should be moving out in less than 30 days?

    Secondly, our subletter moved in, paying only half of the deposit in our agreement. He has stated that he will pay the other half of the security deposit 2 months ago and has yet to do that. Does that also provide grounds for immediate eviction? He violated our agreement and therefore should not the right to live here.

    If so, what is the fastest, cheapest way to get him to leave? Can I show the police our subletter agreement, point out that he has not met any of the conditions, say that he has no legal right to live here and get him to leave? I don't really want a lengthy court motion...can I just change the locks and move his stuff out?

    I forgot, we also believe hes been stealing from our apartment. My roommate has found her HD camera missing and is filing a police report but cannot really "prove" what happened (our bedroom doors don't lock, hes home all the time...etc). Will this be grounds for a faster eviction?

    Instructions on how to evict a tenant can be found here.

    When a tenant doesn't abide by a rental agreement the solution is eviction. They do not automatically become trespassers on your say-so.

    If you choose to illegally evict your tenant, your tenant can sue you. And you can expect that your tenant will win.
