My question involves real estate located in the State of: New York
We have a vacation home on a small lake. The driveway which is used by 6 other homes was sold at auction last year. Our attorney advised that no one purchase the road for liability reasons. We were told that by having a deeded right of way, as we all do, we could continue to use and maintain the road as we have for years.
The new owner of the road purchased it for $500+/-. He sent us a letter attempting to "sell" us the road for $10,000. Needless to say he still owns the road.
Now the issue is our lake's dam. Do we need special permission from the road owner to bring heavy equipment in to make dam repairs? There are over 100 home owners involved in the lake community. And our fear is that this individual may very well make the dam repairs much more difficult than need be.
