    Default How to Move Out of State with Kids During a Divorce

    My question involves a marriage in the state of:MD

    I would like to divorce my husband and move to the West Coast (California). We have 3 children but my husband will not agree to "allow" them to go with me. Can I legally take them out of state then file?

    Since you're married and there are no court orders in place - yes, you can go. However, expect your husband to file in MD to have the kids returned. Do you really want to be going back and forth to MD to attend court?

    Honestly, it's much better to get this sorted out in MD and get permission to relocate from the courts.
