    Default How Long After a Loan is Due Can You Still File a Collections Lawsuit

    My question involves collection proceedings in the State of: New York.

    I lent some money to a friend who was supposed to repay it back in January 2008. It’s been almost 3.5 years and I’m still waiting. What court I would have to go to enforce the payment and can I still file? Another words, is there a time deadline for these types of claims since it’s been 3.5 years?

    For a regular small claims court, it looks like you can sue for up to $5,000. The general statute of limitations for contracts is six years.
