    Default Sealed Record Appears in Background Check; What to Say to Employer

    My question involves expungements or pardons for the state of: TEXAS

    Just as many of you on this forum, my sealed record (petty theft in 2008) unfortunately continues to appear in private databases.
    Although I am legally allowed to say I was never arrested or convicted on job applications, my background checks continue to say otherwise.

    My question is: What am I to say to a potential employer if they reveal they found a criminal record?
    Do I hold my ground and say it never happened or explain the situation and hope for the best?

    Have any of you run into this dilemma?

    Ultimately it's a personal matter for you to decide, not a legal question.
