    Default Charged with Giving Spirituous Liquor to a Person Under 21

    My question involves criminal law for the state of: North Carolina

    I am 22 years old. I was leaving work with my 20 year old friend last week. I stopped by the liquor store on the way home to purchase a bottle of liquor. My 20 year old friend waited in the car. When I walked out of the liquor store and back to my car I opened the door and handed the sealed bottle in the bag to my friend to put in the back seat as I got in.

    An undercover officer was sitting in the parking lot and stopped us before we could leave. He took both our id's and saw that my friend was under 21 and charged me with giving liquor to a person under 21 and charged my friend with possession.

    The liquor was for me and my girlfriend for later that night, and I tired to explain that to the officer, but obviously the crime was committed just by letting my friend touch the bottle I assume.

    I have contacted a lawyer and have a meeting in a few days but I just wanted to gather any information beforehand. Anything would be helpful.

    I think you will have a difficult time explaining why you opened the passenger door and handed your friend the bottle. I can't see why you would do that at all. Why not just get in the car and put it behind the seat or, if it was for your friend, hand it to them inside the car. Why even open the door. Your car has a window I would presume.

    I'm a tall guy and my car sits low to the ground, I just handed it to him out on convenience and stupidity I guess.

    As valid as your view of why you did it might be to you, it will be a tough sell to anybody that he was not intended to drink with you that night. The fact that you handed him the bottle would solidify it for some people.
