My question involves criminal law for the state of: FLORIDA
I was arrested and charged for Manufacture of Controlled Substance, F.S. 893.13(1)a);777.011, Second Degree Felony.
I was pulled over, and the officer searched my vehicle. My vehicle possessed many materials needed to produce methamphetamine. I was then arrested for Manufacture of Controlled Substances. It should be noted that I did not have any methamphetamine on me, or in the car, there was no residue on the meth-making equipment, and most importantly, NO METH WAS MANUFACTURED in the first place... Also, I was missing a generator and Sudafed, which are essential to making meth. How can one make something, if the essentials are not present? Is there any Florida case law, or legal stipulations that can help me with this?
