    Default How to Change Condo Association Declarations

    My question involves a condominium located in the State of: Illinois

    Our homeowners association is governed by the original developer's homeowners agreement, now 10 years old. The agreement/declaration includes both single family homes and townhomes. How can we write a new homeowners agreement(s) that separates the single family homes from the townhomes, so that single family home owners and townhouse owners can each set rules and policies independent of each other?

    Who is "we"? If "we " is the present HOA, then what you should do is go to the real estate lawyer who advises you on legal issues and discuss how to split the HOA into two entities. I would not suggest that as a do-it-yourself project - odds are you'll need to amend the deeds of the affected properties, as well as create a new entity (perhaps two, depending upon whether it's possible to continue the old HOA in relation to some units or if it's necessary or advantageous to dissolve the current HOA).
