    Default Arrest and Incarceration Over a Dropped Charge

    My question involves an arrest warrant from the State of: Michigan

    Short version: My wife was arrested and put in jail over a charge that was dropped over 8 months ago.

    Fri, 6/17/2011
    Friday evening my wife was driving my 7 year old son to the babysitters on her way to work, someone rear ended her. Police came to the accident, ran my wife's name...showed that she had an arrest warrant for a failure to appear which was made 3 days ago (6/15/2011). The failure to appear was for a disorderly conduct charge that was dismissed back in Oct. 2010. The county Sherrifs arrested her, traumatizing both her and my 7 year old. Treated her poorly, patted her down next to the male inmates and placed her in a cell next to them to be terrorized (she had never been in jail prior to this). The magistrate who signed off on the arrest warrant put the bond at $10,000 (which seemed extremely excessive to me?). The only info I could get from the Sheriffs was that although the charge was dismissed, she had a hearing earlier in the week which she missed? We were never informed of a hearing when the charge was dropped, nor did we receive anything in the mail. So we were left with a decision to either leave my wife in jail until Monday morning, or pay a bail bonds man $1,000 to get her released. We paid the $1,000 to get her out and she has a court date on Tue.

    This was the single worst day of my wifes life, we have lost $1,000, my wife and son have both been traumatized, all because of a warrant for a charge that had previously been dropped? I have no idea how this could have happened, or why it did. I'm extremely upset with our local court system.

    I plan on calling as many attorneys as I can tomorrow, but our money is limited for hiring one.

    What do you guys think about all this? What are my options? How can I prove we never got court date? Also what concerns me the most is that my wife threw away the original documents she got from the prosecutor when it was dropped (she thought it was over and done with)....will the court have records of this?

    Oct 2010: My wife and her friend were on the porch (live in a townhouse) having a few drinks, neighbors called the police and complained b/c they were being loud. Police charged them both with disorderly conduct for excessive noise. Wife showed up to her court date, told the prosecutor what happened...he couldn't believe they gave her a ticket...and dropped it. He told her to be good for 6 months and it would fall off her record. Our neighbor had it dropped too, and got 3 months of probation instead of 6. At the present time, our neighbor who had the same exact charge never had a hearing and received mail stating that her charge was dismissed (which we never did).
