    Default Swerving into Opposite Lane to Avoid Accident

    My question involves a traffic ticket from the state of: NJ

    I received a phone call from a Police Officer because a complaint was filed by another driver for swerving in opposite lane. There was no accident and no one stopped. A driver pulled into my lane (took Stop sign) and I swerved into opposit lane and around him. I cannot reach the Officer and would like to know if I can get a ticket for this (even though if I had not swerved I would have been in an accident)?

    So you're saying someone cut in front of you at a stop sign, and yet you were going fast enough that you couldn't stop, so you had to swerve into the opposite lane to go around them?

    An officer can issue a citation based on a witness statement, but generally, the witness will have to appear in court to testify.

    Keep in mind: If you're called by the police for a statement about what happened and describe going into the oncoming traffic lane, your statement can be used against you.

    Oh boy, interesting dilemma. I left the officer 2 messages and in one I said I was cut off but it sounds like I should be careful about how much details I give him. It will be at least 5 days since the incident and am mow wondering if I should just say I don't recall or that car came out and swerved a little.

    well, if you say anything, telling the truth is a really good idea. Lying can cause its own problems and bring its own charges.

    @JK, very good point. I realize I didn't answer the question from That Guy -- yes, I was going 40-45 mph when he took the stop sign and ended up in front of me. Not the best reaction but at the time I didn't think stopping was an option so I swerved around and ended in front of him (it was a 2-lane road with no shoulder).

    Is it reasonable to say 5-7 days later that I don't recall the incident? The Officer only tried to reach me the day of the complaint (last Thursday) and while I've left 2 messages I'm not sure we will connect tomorrow.
