My question involves child support in the State of: CA
CUSTODY
-My ex and I have (undocumented) Joint 50/50 Physical Custody of our 6-year-old child (although we've never been to court)
FINANCES
-My ex makes considerably more $ than I do
-I pay $300-400 per month in health care and daycare costs (the mother of my child does not contribute)
-The mother of my child doesnt contribute to any additional costs (to offset above costs)
-EVERY YEAR, the mother claims Head of Household and Claims our child on her taxes
LIVING SITUATION
-My child's mother lives with a roomate
-I live with my mother (and pay rent). Also, sometimes my child spends the night at my grandmother's house.
I have insisted that moving forward, we alternate years in claiming our child on our taxes - but my childs mother wont agree.
She has threatened to take to me court for child support but according to the CA Child Support calculator, she would end up owing me money.
Is there any validity to her claim that I should pay more since I live with my mother (and pay rent) and sometimes my child spends the night with my grandmother?
It seems like an excuse to me but I'm not sure...
