    Default Should District Attorney and Assistant District Attorneys All Be Named in One Suit

    My question involves court procedures for the state of: Tenn.

    The plaintiff is suing two Assistant District Attorneys for very obvious Prosecutorial Misconduct. Should he also sue the District Attorney because he is their respondent superior?

    You simply can NOT sue the assistant district attorneys. Prosecutorial misconduct isn't even a viable tort in any state I have ever heard of. They have ABSOLUTE immunity from any civil action for anything related to their duties.

    Even if there was some way to do it, you would be insane to try it pro se. Your filing fee will be a total waste of money and chances are they will file for sanctions against you and you'll end up paying their attorney fees. No matter how good you think your case is, trust me, it isn't. You are wasting everyone's time.
