    Default Getting a Divorce Finalized

    Here is the situation...

    I have a friend who is trying to get divorced so she can move on with her life. Her ex-husband seems to not want or will not sign the divorce papers and seems to be stalling in the process. What is she able to do to make or speed up the process of getting the divorve finalized... At this point she is with another guy (engaged) and are having a child with the new man... (awesome guy) anyway... At this point there really is not anything else to debate.. All financial matters are taken care of. However, the ex did open some loans using her ss# and signature... What can she do?

    The state is PA... What advice can you give me so I can help her through this? So far she has not filed for support and she has put all the profit of the house into escrow and it will remain there until he signs the papers. Upon signing the divore papers, the outstanding bills will be paid... One of which is a personal loan that used his mothers CDs as collateral... This loan also has a forged signature on it... HEr attorney said that she could if she wanted to, sue for the CDs.... Because she did not sign for the loan.

    If you mean he won't sign a settlement agreement, he has the right to go to trial if he wants.

    He doesn't have the right to forge her signatures on loan applications. She should talk to her lawyer about notifying the lenders that her signature was forged and that she is not a borrower on the loans - if she delays in notifying them, despite knowing of the forgery, it becomes a lot harder to argue this later.

    At this point we really do not know why he will not sign... There really is no reason for him to hold out... Are there any legal ways that she can go after him to make him sign or... Does she have to wait a full two years for the divorce to be final? The major issue here is time... She is wanting him to sign to get on with her life. At this point she and her new fiance are trying to get a home loan and the lender will not let it go without the divorce papers being signed.

    What should she do? Can she file something or take him to court or something. Also, Should a judge or magistrate be handling any of this or will this be between there lawyers?

    By the way I truelly appreciate the help... It is great.

    If you mean he won't sign a settlement agreement, he has the right to go to trial if he wants. Perhaps her lawyer can suggest a way to speed up the legal proceedings.

    He is doing nothing... The bills are not being payed and the debt is adding up. The attorneys are talking back and forth and nothing is happening... Does he half to sign?

    If you mean he won't sign a settlement agreement, he has the right to go to trial if he wants. No matter how many times you ask the same question, that will remain the case - he doesn't have to settle, and can go to trial.
