My question involves a homeowner's association in the state of: California
Can an HOA president decide to cut down trees on her own? Does this need to be decided by the Board and not a decision to be made on her own?
Someone was called in to look over the property. It was suggested by them that a couple of trees be cut down due to raising of sidewalk, and lifting of a fence. I'm all on-board for that. But, she has decided to go beyond that and wants to cut additional trees because she thinks there are too many trees (no other reason given.)
Without notifying owners of what was suggested, or what she decided to do, we were awoken to trees being cut down by the President's husband, apparently with her permission (but no one else's, including other Board members.)
The president was advised that this should be taken to the members, or at least the board. The president's husband stopped cutting that day but we're afraid he'll start up again without telling anyone. People are angry about trees being cut that are healthy and not affecting anything. We feel that we bought the property with certain aethetic appeal and that cutting the trees will lower our home values.
Is what the president is doing legal? Can she make these decisions on her own without other Board members? (Just as an FYI - the president's husband is legally disabled and probably shouldn't be doing this.)
