My question involves a homeowner's association in the state of: California
We have a problem in my HOA because the HOA president is really unfit to serve - she is on heavy daily meds., has trouble functioning, rarely leaves her house for trouble walking, and cannot continue or understand simple conversations. Her husband is not an owner but is running things in the background and making unpopular decisions for the HOA through his wife (telling her what to do.)
Board members have quit out of frustration of trying to work with her. Every time they meet and agree to things, five minutes after being home, she phones up the board and says she changed her mind and won't allow what was agreed upon! We want to vote her out but don't know how to do it.
I was told (last year) that votes would be taken for new board officers this year. I brought it up during open forum and, after the meeting (after her husband talked to her), she is saying we have to vote in new officers for the current board before we can vote in new board officers.
We have trouble getting quorums but everyone WILL show up if they know that it'll allow for new voting of officers. Problem is that she won't allow it to be put on the agenda. She says the agenda has to stay the same since the last meeting with a quorum...almost a year ago!
Everyone is really discouraged. We want to petition for a vote but she won't allow it. What do we do??? We really could use some help...
