    Default Can You Be Required to Register as a Sex Offender After You Marry the Victim

    My question involves criminal law for the state of: Florida, I thihk
    I work with a university and had a student come in today to enroll. He told me he was a registered sex offender because his wife's parents had him arrested by the military (Army) because he had sex with her before they married when she was only 16. They had been married 4 yrs at this time. He was charged with carnal knowledge. Can that really happen? Someone can be charged with carnal knowledge when the subject is now their wife?

    If the alleged crime occurred prior to their nuptials and any requirements under the law as far as ages are met, most definitely. I do not know why the military legal system was involved unless it occurred on a military base. Offenses by members of the military committed off base are usually handled by civilian authorities.

    The Military can only arrest for violations of the UCMJ, so I am assuming he was enlisted then. This is not an, if you will, Ex Post Facto arrest, as he was NOT married to her at the time.

    In civilian law, even in some states, marriage is not even a defense to such if married in one state where the age is allowed, but not permitted in another and the sex act is done there.
