My question involves a traffic ticket from the state of: CA
Failure to obey a regulatory sign, 21461(a)
Roadway is marked with two lanes, dashed line between both lanes.
There is a Do Not Pass sign 1/4 mile from the end of the two lane section.
WHAT IS THE RULE ON PLACEMENT OF THIS SIGN?
Background:
Sign is R4-1 Do Not Pass. Placement is described in CAL MUTCD, 2010 version, as:
OK, well and good- lets look at pavement markings in 3B.02 for how the lanes SHALL be marked:Option:
The DO NOT PASS (R4-1) sign (see Figure 2B-8) may be used in addition to pavement markings (see Section 3B.02) to emphasize the restriction on passing.
Standard:
When used, The DO NOT PASS sign may shall be used at the beginning of, and at intervals within, a zone through which sight distance is restricted or where other conditions make overtaking and passing inappropriate.
So am I right to be confused that the lane markings allow passing, but the sign restricts passing?Standard:
No-passing zones shall be marked by either the one direction no-passing zone pavement markings or the two-direction no-passing zone pavement markings described previously and shown in Figures
3B-1 and 3B-3.
When centerline markings are used, no-passing zone markings shall be used on two-way roadways at lane reduction transitions (see Section 3B.09) and on approaches to obstructions that must be passed
on the right (see Section 3B.10).
While the sign MAY be used in additon to lane markings, the sign cannot be use instead of lane markings...in other words if the markings allow passing the do not pass sign should be placed were the passing actually ends, and where the pavement markings no longer allow passing.
